These agreements are for the protection of our customers and systems and is fairly
standard legal-ese. Its main purpose is to prevent illegal or abusive practices.

Studio Junkyard Computer Service/Repair Agreement
Studio Junkyard hereby expressly disclaims all warranties, either expressed or implied, including any implied warranty of merchantability, fitness for a particular purpose or any other warranty of any kind on any of the products or services which Studio Junkyard provides.
Computer systems, hardware components, peripheral devices, software and any other tangible component sold by Studio Junkyard, are warranted only by the manufacturer or publisher of such component and are limited to the terms set forth by said manufacturer or publisher. Studio Junkyard is not responsible for obtaining warranty services or performance of warranty terms for any such component.
Services rendered by Studio Junkyard may void manufacturer warranties for a computer system, computer network system, or a related device. Studio Junkyard does not assume any liability or warranty in the event that the manufacturer warranties are voided, we will however advise where a warranty may be voided. Studio Junkyard offers no verbal or written warranty, either expressed or implied, regarding the success of services rendered.
No Consequential Damage: In no event shall Studio Junkyard, its subsidiaries or affiliates, or it’s respective officers, directors, employees, representatives, agents, contractors or suppliers (collectively, "Studio Junkyard") be held liable for special, incidental, consequential, direct, indirect, physical, compensatory, punitive or any other damages, including but not limited to, physical injury, loss of data, loss of use, or loss of profits, however caused, whether for breach of contract, negligence, or otherwise, regardless if Studio Junkyard has been advised of the possibility of any such damages.
Revisions to these terms and conditions: Studio Junkyard may revise these terms and conditions at any time. All revisions to these terms and conditions are effective for transactions dated after the revisions. You agree that if any part of these terms and conditions are found to be unenforceable, the remainder of these terms and conditions will remain in full force and effect.
Ownership: By agreeing to have Studio Junkyard perform services on any computer system, computer network system, or related device, you certify that you are the expressed owner of said computer, computer network system or related device or are an authorized agent for the owner. In the event that you are found not to be the true expressed owner of said computer system, computer network system, or related device, you assume all liability for any claim made as the result of the services rendered by Studio Junkyard on said computer system, computer network system, or related device.
Definitions:
Computer system is defined as the CPU enclosure and software (operating system, applications and other installed software).
Hardware is defined as any individual component that is contained within the Computer System such as hard disk drives, main boards, processors, memory modules or any other component contained within the Computer System.
Peripheral device is defined as any hardware item which attaches to the Computer System such as Printers, Monitors, Cameras, etc.
Data is defined as any information which is not part of the operating system, application software or other installed software such as pictures, word processing documents, email, financial data, or any other user created information stored on the computer system.
Title to Goods: Title to purchased goods is retained by Studio Junkyard until such goods are paid for in full by the purchaser or purchaser’s agent.
Rates and Minimum Charges
Shop Repairs: Diagnosis is charged at $35 per hour.
On Site Repairs: Minimum Charge; $45 residential or $65 business. Charges are billed by the hour.
Estimates: After diagnosing the problem Studio Junkyard will notify you with an verbal estimate to repair your system including any diagnostic charges if applicable. Your oral agreement to repair constitutes an Oral contract in which you agree to pay Studio Junkyard for the diagnostics and repair upon completion. Written estimates will be outlined on a worksheet.
Payment: Unless prior arrangements are made, payment is due when services are rendered. Payment may be by cash, direct deposit. Any other arrangements must be made in advance of services being provided.
Abandoned Items: Unless prior arrangements are made, any item left for repair that is not picked up and paid for within 90 days of completion of said repair will be considered as abandoned. Studio Junkyard will notify you by mail, phonecall or email, that Studio Junkyard considers your item abandoned by you and if the item is not picked up and paid for within 15 days of notification, the item will be recycled, which may mean resold, refurbished, sold, or given to charity. Abandoning and subsequent reuse, resale, recycling, or giving to charity of your item does not relieve you from the amounts due. Studio Junkyard reserves the right to pursue collections and by failing to respond you agree to be liable for any and all costs incurred in such collections. Prior to any further transactions with Studio Junkyard, you will be required to remit in full on any previous amounts due plus provide pre-payment for any further services.
Return Policy: Your original receipt or invoice is required.
If you are not satisfied with a product you purchased from us and you return the product with the original receipt or invoice within 10 days from the original invoice date, you may exchange the product or receive a refund, except as explained below.
Special order Computer Systems are non-refundable and non-returnable. Monitors, printers, and un-opened computer parts may be returned within 10 days from the original invoice date and are subject to a 25% restocking fee (unless defective).
Any product that is returned without all item(s) included with the original product and packaging is non-refundable and non-returnable.
Opened software, games, videos, or computer parts are non-refundable and non-returnable.
Used items are non-refundable and non-returnable.
Refunds will be made in the form of original payment.
Recycling: We offer to our customers free recycling of unwanted or defective Computer Systems, Peripheral devices or hardware components. Hardware items replaced by Studio Junkyard during the course of a repair will also be recycled at no additional charge.
Special Orders:
Computer Systems and Peripheral devices: All computer systems and peripheral devices require a deposit equal to the cost of the system or device. We calculate shipping and delivery costs into the prices.
Shop Repairs: If a part is required to facilitate a repair that is not a standard part in Studio Junkyard inventory, the customer will be required to pay a deposit of 100% of the cost of the part before part is ordered.
On-Site Repairs: If a part is required to facilitate a repair that is not a standard part in Studio Junkyard inventory, the customer will be required to pay a deposit of 100% of the cost of the part before part is ordered.
Over the Counter Parts orders: All “Over the counter” parts orders require a deposit of 100% of the cost of the part before part is ordered.
If for any reason customer decides PRIOR TO REPAIR, not to purchase goods that have been ordered, customer will be solely responsible for shipping costs to and from manufacturer, plus a cancellation charge of 25% of the total order value.
ON-SITE SERVICE
(a) Scheduling: Standard service hours are Monday-Friday, 9AM–5PM. Additional charges may apply for rapid response services or service outside of standard installation hours.
(b) Service Jurisdiction: Studio Junkyard sets the Service Jurisdiction being Queenstown Tasmania only. If you make an onsite booking outside of Queenstown Tasmania, we will contact you.

(d) An Adult Must Be Present At Residences or Business: For on-site services, a person of at least 18 years of age must be present during the entire time period services are provided. IF THE STUDIO JUNKYARD TECHNICIAN ARRIVES AT THE SCHEDULED SERVICE TIME AND NO ADULT IS PRESENT, SERVICES WILL BE DENIED AND A $45 CANCELLATION CHARGE WILL BE ASSESSED.
(e) BACKUP YOUR SOFTWARE AND DATA: IT IS YOUR RESPONSIBILITY TO BACK UP ALL SOFTWARE AND DATA THAT IS STORED ON YOUR COMPUTER'S HARD DISK DRIVE(S) AND/OR ON ANY OTHER STORAGE DEVICES YOU MAY HAVE PRIOR TO THE ARRIVAL OF THE STUDIO JUNKYARD AGENT TO YOUR HOME OR BUSINESS. STUDIO JUNKYARD SHALL NOT BE RESPONSIBLE AT ANY TIME FOR ANY LOSS, ALTERATION OR CORRUPTION OF ANY SOFTWARE, DATA OR FILES.

(g) Access: The Studio Junkyard Technician must receive full access to the computer(s) and/or peripheral(s) to be serviced, access to your residence, your consent and cooperation to enter your residence or business, and a safe working environment, working space and electrical power. IF THE STUDIO JUNKYARD AGENT ARRIVES AT THE SCHEDULED SERVICE TIME AND DETERMINES THAT HE/SHE DOES NOT REASONABLY HAVE THE ACCESS, COOPERATION, OR SAFE WORKING AREA DESCRIBED IN THE PREVIOUS SENTENCE, THEN SERVICES MAY BE DENIED AND A $45 CANCELLATION CHARGE WILL BE ASSESSED.
TERMS APPLICABLE TO PAY FOR SUPPORT AND IN-HOME SERVICES:
LIMITATIONS TO SERVICE: STUDIO JUNKYARD RESERVES THE RIGHT TO REFRAIN FROM PROVIDING ANY OR ALL SERVICES ORDERED AND INSTEAD REFUND THE CUSTOMER'S PAYMENT, WHOLLY OR IN PART, ON THE BASIS THAT THE MINIMUM SYSTEM REQUIREMENTS ARE NOT MET OR THE TECHNICAL NEEDS (INCLUDING WIRING OR OVERCOMING PHYSICAL OR TECHNICAL BARRIERS) OR OTHER REQUIREMENTS OF THE CUSTOMER ARE UNUSUAL OR EXTENSIVE AND BEYOND THE SCOPE OF THIS SERVICE AGREEMENT AS REASONABLY DETERMINED BY STUDIO JUNKYARD.
FORCE MAJEURE: If Studio Junkyard's ability to render services is impaired by you or circumstances beyond the control of Studio Junkyard, Studio Junkyard may choose not to provide services.
LIMITATION OF REMEDY: UNDER NO CIRCUMSTANCES SHALL STUDIO JUNKYARD BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, EXPENSES COSTS, PROFITS, LOST SAVINGS OR EARNINGS, LOST OR CORRUPTED DATA, OR OTHER LIABILITY ARISING OUT OF, OR RELATED TO, THE SERVICES PROVIDED BY STUDIO JUNKYARD OR OUT OF THE INSTALLATION, DEINSTALLATION, USE OF, OR INABILITY TO USE YOUR COMPUTER EQUIPMENT, HARDWARE, PERIPHERALS, OR THE NETWORK RESULTING FROM THE SERVICES PROVIDED HEREUNDER.
RELEASE OF LIABILITY: BY ORDERING SERVICE, YOU AFFIRMATIVELY RELEASE AND HOLD HARMLESS STUDIO JUNKYARD FROM AND AGAINST ANY LOSS, LIABILITY, OR DAMAGE THAT YOU OR THE OWNER OR LESSEE MAY SUFFER, INCLUDING BUT NOT LIMITED TO ANY LOSS OF ANY DATA AND THE NON-FUNCTIONING OF ANY COMPONENT OR ELEMENT OF YOUR COMPUTER EQUIPMENT OR PERIPHERALS RESULTING FROM STUDIO JUNKYARD, REGARDLESS OF THE WARRANTIES, DISCLAIMERS AND WAIVERS PARTICULAR SERVICE AND SHALL CONSTITUTE LIQUIDATED DAMAGES AND ARE A REASONABLE ESTIMATE OF DAMAGES TO YOU.
CHANGES, CANCELLATIONS AND REFUNDS
To change your order you must contact Studio Junkyard either via email @ info@studiojunkyard.com or phone on 0364 711 372 .
You may cancel your order if you give
Studio Junkyard at least 24 hours notice prior to the scheduled performance of services.
IMPORTANT: Due to the unpredicatable nature of complex computing systems, business environments (including but not limited to servers, networks or VPN connections) are NOT warrantied or covered by this warranty period.

Costs: The cost of your web site depends on what is needed for the web site to function as per required for your business. Studio Junkyard endeavours to provide a cost effective solution for your business, and as such the backbone of your web site will use gnuSite a free of costs Open Source Software provided and maintained by Studio Junkyard, with charges made to you to cover design costs of the layout of your web site, and any additional pages or services added into gnuSite as needed over and above what gnuSite currently provides. Copyright: Final products developed by Studio Junkyard are the sole property of the customer once payment has been made in full. However, the initial concepts and intellectual rights remain the property of Studio Junkyard. We also retain the right to place products developed on the portfolio page of our website and/or Advertising system.
Turnaround Time: Studio Junkyard will commence work on designing your layout, once at least half of the agreed upon quote has been made, and an initial design has been agreed upon. Usually a design is agreed upon, before payment. Studio Junkyard at that time may at it's discretion (being before payment) decide to start the design work, but will NOT forward concept work to you until at least half the quoted payment has been made.
Studio Junkyard will make it's best effort's to complete concept work for the layout of your web site inside a 7 day period (most designs take 1-2 days depending on complexity), after half the quoted payment has been made. If a design is overly complex, for e.g. needs to have 3D design work involved or require's a longer time to complete, Studio Junkyard will inform you upon the original quote, or contact you via email or phone to let you know how much time may be required to undertake the work.
Once you receive works for approval, we require that you make your approval within 7 days, unless otherwise arranged, at which point we will not continue further until we get approval, so we do not waste ours and your time doing works that won't work. We give it 7 days at most (unless otherwise arranged) for approval, as we understand you may need time to make a decision and to gain insight from other's for design idea's.
Payments: We accept, Direct Deposit, Cash, or in some limited cases and agreed upon by both parties we may accept Contra Deals.
Bank details will appear at the bottom of quote's and invoices.
During Design Phase: During the time Studio Junkyard is designing the layout for your web site, and you are also hosting with us you will be getting the below benefits:
- Studio Junkyard will NOT charge hosting while your site layout is being designed.
- Your required email services will be up and running.
- An "Under Construction", or "Web Site Coming" page will be put up, with Title and Keywords place on those pages to help your SEO rankings with google before your finalized web site is up and running.
- Free advertising within our advertising system. Advertising will appear on other web sites choosing to display advertising on their web site.
Once Your Web Site is Up and Running: Once your web site is up and running, there may be some legal responsibilities you need to be made aware of for continued hosting and or usage, and for general online exposure of any content you decide to put on your web site, including and not limited to: copyright material, pirated software, illegal content including pornography which may include child pornography, bestiality, hard-core pornography, and others not allowed by law. Studio Junkyard may at anytime remove such content at it's discretion. Studio Junkyard takes no liability for costs, defamation, loss, loss of data, for information that you may contacted or sued for, for any reason. If Studio Junkyard is contacted for infringing information to be removed, it will be done at your cost at $250 AU per hour. For a more in depth description of the hosting and content allowed please read the "Hosting Service Agreement" below.
Liability: In no event or circumstance will Studio Junkyard be liable for suitability, merchantability, or usability of products developed and delivered.
Termination Policies: You can ask to put a design "on hold" at any time, then resume it's development. If you wish to cease hosting or development of your web site you will be liable to pay at least half the original quoted amount for the web site if that amount has not been made. If you have paid more than half the original quoted amount, then we retain the rights to refund the amount over half the original quoted amount. This will depend on development costs incurred during the initial design process.
For termination of hosting, you will be required to pay the current months hosting or if behind the total amount owed plus the current month.

Studio Junkyard Hosting Service Agreement
Studio Junkyard seeks to provide you with top quality technology and service thus allowing you the opportunity to administer your own web site on the World Wide Web (WWW) in the most efficient and effective way possible. We continually upgrade our software being gnuSite, and provide support to help you achieve your goals in hosting.
Studio Junkyard reserves the right to refuse service to anyone at any time. However, if Studio Junkyard should deem it necessary to initiate termination of services with you, Studio Junkyard specifically agrees to provide backups of your Web Site and Data, and provide such data in the most convenient manner to Studio Junkyard, to you which may still reside on the web site or server being removed from the network. In no event shall Studio Junkyard be liable for any loss, loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages, which result from this termination of services.
Costs: Studio Junkyard charges hosting at the end of each month on the 28th day of each month. You may pay in advance if you wish. Hosting is due 7 days of receiving the invoice. If payment or payment arrangements have not been made, you have 7 days to resolve the payment. This is called a grace period. If you have failed to make complete payment or other arrangements 14 days after receiving the invoice then Hosting Services will be suspended. If no contact or payment has been made 1 month after receiving the invoice, we will consider that you no longer wish to continue using our hosting services. From that point your data will be archived, the account deleted from the server, and you will receive a further invoice to pay amounts owing (see "Termination" below).
You can make arrangements for payment to avoid having your web site and services from being disabled.
Termination: For termination of hosting, you will be required to pay the current months hosting or if behind the total amount owed plus the current month. You will also be charged an Adminstrative Fee of $45.
Web-site Content. Your content will remain in your designated domain space and is not available to any other entity. You have the right to retain on your designated domain space: any and all files that you seek to hold that do not violate the following rules. Customers are prohibited from transmitting on or through any of Studio Junkyard's Web Hosting's services, any material that is, in Studio Junkyard's sole discretion: unlawful, obscene, threatening, abusive, libelous, encourages criminal mischief, gives rise to civil liability, or otherwise violates any local, state, federal, or international law and/or treaties. In short, Studio Junkyard's services may only be used for lawful activities.
Studio Junkyard does not allow connection to, or use of, any software or 'bots' for IRC or the reselling of 'shell accounts'. These are deemed as high security risks and if found will result in account suspension or termination with no refunds under any circumstances.
Pornography: Studio Junkyard has a zero tolerance policy on pornography that violates local, state, federal, or international law. This includes, but is not limited to, child pornography, bestiality, hard-core pornography, and others not allowed by law. Studio Junkyard does not seek to abridge any users rights, but we uphold any and all laws applicable to the content of sites hosted on our servers and/or network. Studio Junkyard reserves the right to deny service without cause for sites with adult content that we deem violates local, state, or federal law.
Studio Junkyard does take an active role in monitoring all sites via the web for content that does not comply with the preceding guidelines. Studio Junkyard specifically retains the right to make the final decision in any matter relating to site content.
Network. Our services were designed to give you the maximum freedom of administration and access to the Internet at the lowest cost available.
Studio Junkyard customers may not use our network to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the customer is not expressly authorized to access, password cracking, probing the security of other networks or directly violating the security policy of another organization. Customers are also not allowed to interfere or deny service to any user, host, or network by flooding, mail bombing, or attempts to overload or crash the host network. Any violation of the network guidelines set forth will result in deactivation of your hosting service.
Mass Mailings. Studio Junkyard has a zero tolerance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as: the sending of the same, or substantially similar, unsolicited electronic mail message, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes email with forged headers, compromised mail server relays, and false contact information. This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of the Studio Junkyard servers and/or network. Violation of the above terms will result in one or all of the following:
- A warning from Studio Junkyard personnel via email or phone.
- Removal of DNS for the advertised/originating site.
- Temporary shutdown of the web site or a block on outgoing mail.
- Permanent termination of service WITHOUT REFUND.
Repeat violation of the above terms will result in the following actions:
- Immediate termination of service with no re-activation.
- A $2000.00 AU fee assessed and charged to your account for violation.
- Absolutely NO REFUNDS for ANY REASON AT ALL.
- Additional $50.00 AU fee charged to your account per email sent after notification.
If your actions have caused Studio Junkyard's servers or IP Addresses to be placed on ANY blackhole lists and other mail filtering software systems used by ISP’s and Web Hosting companies around the world, you will be assessed a $1000 AU charge to your account and $250 AU per hour for administrative charges incurred to remove and protect our servers and/or IP Addresses. If you have further questions about our mass mailing policy, please send them to info@studiojunkyard.com. If you want to report abuse by one of our users, please send the e-mail to info@studiojunkyard.com.
Mailing Lists: Our mass mailing rules also apply to mailing lists, list servs, or mailing services you may contract with. Our policy is the following: An acceptable mailing list will be focused at a target audience that has voluntarily signed up for your e-mail information or that has made their e-mail address available for distribution of information from you. Your own list servs in which customers have signed up for in the past, is a valid mailing list. If one of your members asks to be removed, please remove them as soon as feasibly possible. Internally created mailing lists are valid as long as your customers agree to receive the e-mail. Purchased mailing lists are generally a violation of the rules because you have not received authority from the recipient to send them an e-mail. The final rule to all mailing lists is simple: if your customers begin to send spam complaints to Studio Junkyard about your e-mail, you will be bound to the terms of mass mailings listed above. Password Protection: Studio Junkyard will turn over the administrative username and password for your account at the commencement of the contract. This username and password will be kept in your confidence throughout the contract term.
Copyright Infringement – Software Piracy: During the term of the hosting contract, Studio Junkyard grants Customer a non-transferable, non-exclusive license to use the Software gnuSite, in object code form only, for its internal needs, to be used solely on the Hardware provided, and solely in conjunction with the Services. Customer agrees that it will not, directly or indirectly copy the Software, except as is necessary to install on Hardware and for internal, archival purposes. In the event Customer makes any copies of the Software, Customer shall reproduce all proprietary notices on such copies; reverse engineer, decompile, disassemble, modify or otherwise attempt to derive source code from the Software; sell, lease, license, transfer, give possession of, or sublicense the Software or the documentation to others; write or develop any derivative or other software programs, based, in whole or in part, upon the Software or any Confidential Information.
The location of third party software found in your home directory that violates Copyright law is prohibited. Studio Junkyard will work with the appropriate authorities in locating and removing any and all software that is deemed to be used in violation of a valid software license. Please do not locate, use, install, execute, or store software that you do not own a valid software license to, on Studio Junkyard's servers. Violators will be terminated immediately and referred to law enforcement authorities.
IP Addresses: Studio Junkyard MAY assign and allow the use of IP addresses to the customer for the length of the contract. These IP addresses are the sole property of Studio Junkyard or its network provider, are non-portable, and will be retained after service has ceased. Studio Junkyard does reserve the right to change the customer IP address designation at any time. The use of an IP Address outside of your assignment by Studio Junkyard will result in a $250 per hour administrative fee to restore correct IP addressing. This is also viewed as a breach of network security and your account will be taken offline until the problem is resolved. Administrative fees will be billed to your account the following business day.
Suspension: Studio Junkyard specifically reserves the right to suspend network service to your account at our discretion. Suspension will only occur for violation of our AUP, non-payment for services, or by request of legal authorities with proper legal documents. Suspension will only occur for the absolute minimal amount of time to resolve the issue at hand.
SERVICE INTERRUPTIONS. Customer understands and agrees that occasional temporary interruptions of any Internet Services may occur as normal events in the provision of the Internet Services. Studio Junkyard agrees to exercise reasonable care to prevent such occurrences; however, under no circumstances will Studio Junkyard be held liable for any financial or other damages due to such interruptions. In no event shall Studio Junkyard be liable to Customer or any other person for any special, incidental, consequential or punitive damages of any kind, including, without limitation, refunds of fees, loss of profits, loss of income or cost of replacement services.
Governing Law and Forum. This Agreement shall be governed and interpreted according to Australian and/or United States Law. For all disputes arising out of or related to this Agreement or Service Orders, the parties irrevocably consent to the exclusive jurisdiction of the Courts of Australia or the United States. Customer’s address for purposes of service of process shall be the address designated for notices in this Agreement. In connection with all actions in which Studio Junkyard is awarded amounts due from Customer, Studio Junkyard shall be awarded (either in that action or by way of a separate action) its costs and expenses of litigation (including reasonable attorneys’ fees), through trial and appeal. Studio Junkyard may at its sole discretion seek leave to conduct any legal process as described herein in any jurisdiction of any country where a customer or defendant cannot otherwise be brought to order under the laws of Australia or the United States.
LIMITATION OF LIABILITY. Studio Junkyard’s liability (including, for purposes of this paragraph only, any of its employees, agents, or representatives), to Customer (either directly or as a third party defendant in any action or proceeding) for any claim arising out of or relating to this Agreement or Service Orders or the provision of any Services under Service Orders (including, without limitation maintenance and support) shall be limited to the amount of fees paid by the Customer to Studio Junkyard under this Agreement within one year preceding the date Customer contends its claim arose. In no event shall Studio Junkyard be liable for any loss of data, loss of profits, cost of cover, or any other special, incidental, consequential, indirect or punitive damages, however caused and regardless of theory of liability. This limitation will apply even if Studio Junkyard has been advised of, or is aware of, the possibility of such damages.
DISCLAIMER OF WARRANTIES. Studio Junkyard specifically disclaims all implied warranties, including but not limited to, the implied warranties of merchantability and fitness for a particular purpose. Except as otherwise provided in this Agreement, any written materials by Studio Junkyard, or information on Studio Junkyard's web site, shall be for informational purposes only and, whether delivered or disseminated before or after the date of this Agreement, shall not create any express or implied warranties, guarantee of performance, or contractual obligations. Studio Junkyard also reserves the right to change prices for no reason, and at any time.
Any violations of the above policies will result in immediate suspension of services and/or termination of your service. By entering into a hosting contract with Studio Junkyard you agree to be bound by these policies, terms and conditions.
